abstractUnter dem Eindruck der Finanz- und Wirtschaftskrise hat die EU das Instrumentarium zur Regulierung des Finanzmarktes weiterentwickelt und verschärft. Dieser Prozess hat auch Auswirkungen auf die Akteure am Europäischen Kohlenstoffmarkt und ihre Handelsstrategien. Dieser Abschlussbericht versammelt die Ergebnisse von drei Analysen: (i) eine juristische Analyse der verschiedenen Änderungen in der EU-Finanzmarktregulierung, und ihrer möglichen Auswirkungen auf die Akteure am Europäischen Kohlenstoffmarkt; (ii) eine empirische Analyse der Akteure am Europäischen Kohlenstoffmarkt, gestützt unter anderem auf eine Auswertung von 400 Unternehmen mit ETS-Bezug und ihrer Mitgliedschaften an den führenden Börsen für Emissionszertifikate, sowie ihren Konten im Europäischen Emissionshandelsregister, und (iii) die Auswertung einer Befragung unter den deutschen Anlagenbetreibern, die unter den EUEmissionshandel fallen, zu ihren jeweiligen Handelsstrategien, ihren bevorzugten Zugangskanälen zum Kohlenstoffmarkt, und ihren Erwartungen für die zukünftige Entwicklung. Die unterschiedlichen Bestandteile des Projekts ergänzen sich zu dem Bild, das nur sehr wenige Marktakteure den Kohlenstoffmarkt in seiner gesamten Komplexität und Vielfalt nutzen, und dagegen ein großer Teil der Akteure eine sehr begrenzte, pragmatische Handelsstrategie verfolgt, die sich auf das nötigste beschränkt. Auch deshalb sind die Änderungen, die sich durch die Europäische Finanzmarktregulierung ergeben, letztlich nur für einen kleinen Teil der Marktakteure am Europäischen Kohlenstoffmarkt relevant – der allerdings einen großen Teil des Handelsvolumens auf sich vereint.

abstractRolf H. Weber analyses the technological infrastructure environment and the regulatory theories developed in the Internet Governance context. Based on this foundation the transnational normative ecosystem is outlined, followed by a detailed discussion of the substantive Internet Governance principles (such as legitimacy, participation, transparency, accountability). These considerations lead to the presentation of relevant international legal concepts (duty of cooperation, global public goods, shared spaces, due diligence, State responsibility) that merit more attention. The outlook proposes potential approaches for improving the future of the Internet Governance design.

6. Consumer Protection Through Soft Law in an Era of Global Financial Crisis
abstractThe global financial crisis triggered a vast number of new laws and regulations at international level, including initiatives that can be classified as "soft law". The legitimacy and efficacy of these new norms are subject to intensive academic and political debates. At the same time, soft law is changing its role and is gaining new importance. The article looks at the adapted legal environment in financial markets from a consumer protection angle.At first glance, soft law does not seem to provide for adequate measures protecting depositors and investors. Financial consumer protection requires enforceable regulation, but soft law, by its very nature, does not encompass this feature. Nonetheless, soft law should not be construed as having no importance with regard to financial consumer protection. The article suggests that soft law does have important protective potential, both in terms of the mechanisms that it provides, as well as in terms of its substantive content

7. The Future of Data-Driven Finance and RegTech : Lessons from EU Big Bang II
abstractEurope's path to digitization and datafication in finance has rested upon four apparently unrelated pillars: (1) extensive reporting requirements imposed after the Global Financial Crisis to control systemic risk and change financial sector behavior; (2) strict data protection rules reflecting European cultural concerns about dominant actors in the data processing field; (3) the facilitation of open banking to enhance competition in banking and particularly payments; and (4) a legislative framework for digital identification imposed to further the European Single Market. The paper analyzes these four pillars and suggests that together they will underpin the future of digital financial services in Europe, and – together – will drive a Big Bang transition to data-driven finance. These seemingly unrelated pillars together bolster an emerging ecosystem which aims to promote a balance among a range of sometimes conflicting objectives, including systemic risk, data security and privacy, efficiency, and customer protection. Furthermore, we argue Europe's financial services and data protection regulatory reforms have unintentionally driven the use of regulatory technologies (RegTech) by intermediaries, supervisors and regulators, thereby laying the foundations for the digital transformation of both EU financial services and financial regulation. The experiences of Europe in this process provide insights for other societies in developing regulatory approaches to the intersection of data, finance and technology

8. A New Trade Regime For Digital Assets
abstractAlready for twenty years it is acknowledged that e-commerce or (more broadly worded) digital trade cannot be adequately captured by the existing GATT and GATS framework; the new technological developments (particularly the distributed ledger technology and the digital assets) stretch the old categories too much. In view of the weaknesses of the WTO, the implementation of a completely new framework established by other bodies appears to be desirable. Different stakeholders such as standardization organizations and industry associations should attempt to achieve a minimal structural “environment” that allows developing suitable standards and implementing harmonizing rules

9. Internet Governance und Privatsphärenschutz : wohin geht der Weg?
abstractDas Internet hat nicht in erster Linie qualitativ, sondern hauptsächlich quantitativ die Anforderungen an die Gewährleistung des Privatsphärenschutzes erhöht. Die steigenden Informationsansprüche von Privaten und Unternehmen sowie die erweiterten informationellen Handlungsmöglichkeiten des Staates, teilweise auch gepaart mit einer gewissen Sorglosigkeit der Individuen bei der Offenlegung persönlicher Daten, machen einen effektiven Privatsphärenschutz im Informationszeitalter schwierig. Der Grat der Komplexität wird noch dadurch erhöht, dass die Verfügbarkeit von Informationen global ist, und zwar im Gegensatz zu den rechtlichen Regelwerken. In einer neuen Ausgabe der Global Governance Spotlights analysiert der Autor Professor Rolf H. Weber, Inhaber des Lehrstuhls für Privat-, Wirtschafts- und Europarecht an der Universität Zürich, das Spannungsfeld zwischen Informationsverbreitung und Privatsphärenschutz und gibt Empfehlungen, wie die Politik sich diesem annehmen sollte.
