1. Intellectual property rights and health : the constraints of WHO authority and the rise of global health governance as an element of contestation

abstract

This paper links the main issues of the project "Contested World Order" (WZB, GIGA, HSFK) to the policy field of global health: the authority of the institutional setting, and the preferences and strategies of rising powers and non-state actors (NStAs) - the assumed protagonists of recent power shifts. The first part discusses the loss of WHO authority since the rise of Global Health Governance, and WHO's fight to reassert its position. The core of the paper deals with the conflict on intellectual property rights (IPRs) and access to medicines as a central issue in global health. Between 1995 and 2005, civil society organizations (CSOs) and some emerging powers fought successfully for improving access conditions under the TRIPS agreement (Doha Declaration). WHO's activities to regain the initiative led to the adoption of the Global Strategy and Plan of Action on Public Health, Innovation and Intellectual Property (2008) (GSPoA). Chapter 4 analyses the role of NStAs and rising powers (notably BRICS) during negotiations on implementing GSPoA. While CSOs insisted on a binding R&D treaty, BRICS countries finally agreed to more modest results. They support the welfare-orientation and the intergovernmental character of WHO but without seriously challenging basic rules in the global economy. Finally, consensus within WHO was restraint to issues which did not touch the basic IPR framework.

2. Raum, Welt, Wirtschaft: Andreas Predöhl - eine deutsche Wissenschaftlerkarriere

abstract

Die Karriere von Andreas Predöhl ist typisch für viele prominente deutsche Wissenschaftler der Nachkriegszeit, die zuvor während der Herrschaft des Nationalsozialismus diesem Regime gedient hatten. Von 1934 bis 1945 war Predöhl Direktor des Kieler Instituts für Weltwirtschaft, von 1949 bis 1960 Ordentlicher Professor in Kiel und Münster und von 1964 bis 1969 der erste Präsident des Deutschen Übersee-Instituts, des heutigen GIGA. Diese Arbeit liefert eine ausführliche kritische Bewertung seines Verhältnisses zum Nationalsozialismus, aber auch seines wissenschaftlichen Beitrages, der vor allem in Untersuchungen zu folgenden Themen besteht: a) zur Entwicklungstheorie, b) zur Theorie der raumbildenden Standortfaktoren vor dem Hintergrund der internationalen Diskussion über die weltwirtschaftlichen Raumstrukturen und c) zu neuen Wachstumskernen in der Weltwirtschaft und zum Spannungsverhältnis zwischen nationalstaatlichen Interessen und Steuerungsmöglichkeiten in der Globalisierung. Die Arbeiten von Predöhl liefern Anknüpfungspunkte für die heutige Forschung zu diesen Themen und damit wichtige Ansätze zum Verständnis der Dynamik einer sich zentrisch entwickelnden Weltwirtschaft. Seine aktive Verstrickung in das Terrorregime des Nationalsozialismus weist aber auch darauf hin, dass der Wissenschaft als Element politischer Praxis eine wichtige Verantwortung zukommt.

4. Die Schweinegrippe und die Internationalen Gesundheitsvorschriften

abstract

Mit dem Ausbruch der Schweinegrippe - offiziell jetzt A(H1N1) - in Mexiko erscheint am Horizont erneut die Gefahr einer Grippepandemie, die ähnlich wie die Pandemien des 20. Jahrhunderts (u. a. die Spanische Grippe 1918-1919) Hunderttausende oder gar Millionen Opfer fordern könnte. In den letzten Jahrzehnten haben die internationale Mobilität und damit auch die potenzielle Verbreitungsgeschwindigkeit von Infektionskrankheiten erheblich zugenommen, andererseits ist mit den neuen International Health Regulations (IHR, deutsch: Internationale Gesundheitsvorschriften IGV) ein starkes Instrument zum Monitoring und zur Kontrolle von öffentlichen Gesundheitsgefahren von internationaler Bedeutung entstanden. Die Gefahr, dass sich die Schweinegrippe zu einer neuen Grippepandemie ausweitet, wird von den Experten sehr ernst genommen (Quelle: Verlag).

5. Global Governance and Supporting Renewable Energy Development in the South

abstract

Developing adequate energy supply structures especially in rural areas of developing countries is seen as a major challenge to be addressed by the global community. Renewable energies will most probably play an essential role in this context. Developing countries dispose of a large potential for renewable energy generation, but in general – basically at least all Low Income Countries (LICs) – lack the capacities and financial means to develop systems of supporting new forms of renewables. In recent years there have been a large number of organizations and enterprises supporting technological development, carrying out advocative actions and offering finance for the spread of renewable energy alongside many private for-profit actors who try to capitalize on the public incentives and financing programs. Concomitantly, there have been a number of attempts to coordinate activities in this field, which can be characterized either as a subfield of global energy governance, global climate governance, or global governance of development. The objective of the paper is twofold: ● First, an overview of the global governance structure is given (“institutional mapping”) showing a steady proliferation of actors and approaches. Similar phenomena can be observed in the area of development in general or other fields of global governance. ● Second, some (tentative) explanations for the developments are given drawing upon multi-level analysis, transaction cost economics, and investment decision theory. Methodologically, the paper builds mainly on a review of the literature. Some additional information is drawn from expert interviews

10. AIDS, access to medicines, and the different roles of the Brazilian and South African governments in global health governance

abstract

The present article illustrates how the main actors in global health governance (GHG) - governments, nongovernmental organizations (NGOs), intergovernmental organizations (IOs), and transnational pharmaceutical companies (TNPCs) - have been interacting and, as a result, modifying the global health architecture in general and AIDS treatment in particular. Using the concept of "power types" (Keohane/Martin) and "interfaces" (Norman Long), the authors examine the conflicts among major GHG actors that have arisen surrounding the limited access to medicines for fighting HIV/AIDS basically as a result of the Agreement on Trade Related Intellectual Property Rights (TRIPS), in force since 1995. They then analyze the efforts of Brazil and South Africa to obtain fast and low-cost access to antiretroviral medication against AIDS. They conclude that while policy makers in the two countries have used different approaches to tackle the AIDS problem, they have been able, with the support of NGOs, to modify TRIPS and change some WTO rules at the global level along legal interfaces. At the national level the results of the fight against AIDS have been encouraging for Brazil, but not for South Africa, where authorities denied the challenge for a prolonged period of time.
